Decree on the register of incentives in the Republic of Srpska

The Decree on the Register of Incentives in the Republic of Srpska regulates the content, the method of maintaining, and other matters related to the Register of Incentives in the Republic of Srpska. The Decree was adopted with the aim of establishing a unique, central, and electronic register of all incentives granted to business entities in the Republic of Srpska, regardless of whether the funds are provided at the Republic or local level. The adoption of this Decree ensures a unified overview of available and disbursed incentive funds, enhances coordination and information exchange between incentive-granting institutions, enables public access to available and disbursed incentive funds, and creates higher-quality statistical and analytical foundations for the needs of the institutions of the Republic of Srpska, all with the objective of stimulating business activities and improving the incentive allocation system.

The aforementioned Decree prescribes that the Register shall contain basic data on the incentive, its purpose, the type of financial incentive, the grantor and the implementer of the incentive, financial indicators and the status of the incentive, the incentive beneficiary, the implementation of incentives per beneficiary, data on any potential misuse of incentives, as well as notes.

The Decree prescribes that the Register, through its management application, shall be accessible via a public and an administrative portal. The public portal contains information on the Register itself, public invitations, and available incentives, and enables an overview per beneficiary within an individual incentive. The administrative portal contains detailed data on incentives and is intended exclusively for registered users, i.e., authorized persons.

The Register shall be maintained by the Ministry of Economy and Entrepreneurship, which shall appoint a Register administrator-coordinator among its employees. The administrator-coordinator is authorized to enter data of institutions at both the Republic and local levels into the Register and to assign accounts to administrators within the institutions, as well as to the administrator within the Ministry, thereby ensuring unified user access management and the smooth functioning of the Register.

The responsibility of the incentive implementer for the content, accuracy, and timely entry of incentive data into the Register is prescribed, as well as the obligation to enter all data and changes of significance to the content of the Register within eight days from the day of the incentive disbursement or the occurrence of the change, and no later than January 31st of the current year for incentives from the previous year. Simultaneously, it is regulated that the data from the administrative part of the Register may be used exclusively for statistical and analytical purposes, with an obligation for all authorized persons to ensure an appropriate level of data security and confidentiality during their processing.

The method of entering incentive data into the Register via its management application is regulated, as well as the procedure for appointing Register administrators within the institutions participating in the incentive allocation system. At the same time, the authorizations of administrators and other authorized persons for data entry, modification, and review are regulated, along with the method of granting access rights and the scope of data access depending on the level of competence.

The competent ministry is entrusted with the tasks of monitoring the data update in the Register, ensuring the availability of data through the portal, and maintaining the Register and its smooth functioning. In addition to the aforementioned, the method of conducting checks on data updates is established, along with the obligation to provide financial resources for the maintenance of the Register in the budget of the Ministry, as well as the possibility of informing the Government of the Republic of Srpska about the data from the Register whenever the need arises.
